MSHA regulates the approval of portable methane detectors for use in mines to ensure safety. The regulation mandates record-keeping and governs design changes.
Without this regulation, miners would face significantly higher risk of methane explosions as there would be no federally enforced safety standard for these life-critical devices. The market alone cannot reliably ensure safety due to information asymmetries (miners cannot easily assess detector quality) and the catastrophic nature of failures. MSHA's technical requirements and testing provide a knowable, objective baseline that would be difficult to replicate through private means, especially given the high stakes and potential for a race-to-the-bottom if left solely to state regulation. The compliance costs are justified by the prevention of mass-casualty events.
